The Choose Act was passed into law by Governor Kay Ivey in March 2024

Applications open: January 2, 2025

Start date: 2025-2026 academic year

Value: State funding through refundable tax credits up to $100 Million

Up to $7,000 per child at an accredited participating school. Up to $2,000 per home schooler, $4,000 cap for families with 2 + home schoolers. 

Eligibility for Year 1: 

The first 500 ESA’s will go to families of students with special needs. 
Next, preference is given to active duty military whose child is assigned to a “priority school” or “failing school”. 
The remaining ESA's  will give preference to students of families that have an adjusted gross income not exceeding the 300th percentile of the federal poverty level for the preceding tax year. I.E., around $90,000 for a family of 4.
*Priority is given to siblings of participating students.  

Qualifying Expenses: Tuition and fees at a participating school, textbooks, instructional materials, education software, and a few other discrete categories. 

Accountability: Parents and participating schools must agree to follow all program rules. However, there are no limitations or mandates regarding instructional content or curriculum.
